These Terms govern your use of Toxic Ideas ("Service") operated by Toxic Ideas — by Possibly, Sinnhub 2, 5541 Altenmarkt, Austria, UID ATU78856819 ("we", "us"). By creating an account or using the Service you agree to these Terms.
1. The service
Toxic Ideas is a web application that helps founders test, document, and validate startup ideas using AI-assisted workflows. We grant you a non-exclusive, non-transferable, revocable license to use the Service for your own personal or business purposes, subject to these Terms.
2. Your account
You must provide accurate information when you sign up and keep your credentials secure. You are responsible for everything that happens under your account. You must be at least 16 years old, or the age of digital consent in your country if higher.
3. Acceptable use
You agree not to:
- use the Service to violate any law or third-party right;
- upload or generate content that is unlawful, harmful, harassing, or infringes intellectual property;
- attempt to gain unauthorised access to the Service, scrape it at scale, reverse-engineer, or interfere with its operation;
- resell, sublicense, or use the Service to build a competing product;
- use the Service to train machine-learning models, except for models you build for your own internal use within the Service.
We may suspend or terminate accounts that violate this section without prior notice when necessary to protect the Service or other users.
4. Your content
You keep all rights to the content you create, upload, or generate using the Service ("Your Content"). You grant us a limited, worldwide, royalty-free licence to host, store, transmit, and display Your Content solely for the purpose of operating the Service for you. We do not use Your Content to train our own or any third-party AI models.
You represent that you have the necessary rights to the content you provide and that it does not infringe any third-party right.
5. AI features
The Service uses third-party large language models to generate responses, summaries, and suggestions based on your input. AI output may be inaccurate, incomplete, biased, or otherwise unsuitable for your purpose. You are solely responsible for reviewing AI output before relying on it, and you must not use it as a substitute for legal, financial, medical, or professional advice.
AI usage consumes credits from your account. We may rate-limit or temporarily suspend AI features to protect the stability of the Service or to manage cost.
6. Beta status
The Service is currently offered as a beta. Features may change, break, or be removed without notice. We may modify pricing, limits, or available functionality at any time. Beta access may be suspended or terminated at our discretion.
7. Payments
Paid plans are billed through Polar Software, Inc.("Polar"), which acts as our Merchant of Record. Polar is the seller of record for tax, invoicing, and chargeback purposes; the underlying SaaS service is provided by us. By purchasing a plan you also agree to Polar's terms of service.
Subscription fees are charged in advance for the chosen billing period (monthly or annual). All prices are exclusive of VAT or sales tax unless otherwise stated; Polar collects the applicable tax based on your location at checkout.
8. Refunds & cancellation
Cancelling a subscription
You can cancel your subscription at any time from the Billing area of your account or by emailing support@toxicideas.ai. Cancellation takes effect at the end of your current billing period; you keep access until then.
EU 14-day right of withdrawal
Consumers in the European Union have the right to withdraw from a purchase of digital services within 14 days without giving any reason (§§ 11 ff. FAGG).
You expressly waive this 14-day right of withdrawal when you start using the Service or AI credits before the 14 days have elapsed, and you acknowledge that you lose the right of withdrawal once performance has begun. We require this consent at checkout in line with §18 (1) Z 11 FAGG.
Refund policy
Outside the situations described above we do not offer refunds for subscription fees that have already been paid. Refund requests are considered case by case and processed via Polar in line with Polar's refund policy. Mandatory consumer rights under your local law are not affected.
9. Warranty disclaimer
To the maximum extent permitted by law, the Service is provided "as is" and "as available". We make no warranties, express or implied, regarding fitness for a particular purpose, uninterrupted or error-free operation, accuracy of AI output, or continued availability of any feature. We do not guarantee any service-level (SLA), response time, or 24/7 availability.
10. Limitation of liability
To the maximum extent permitted by law, our total aggregate liability arising out of or relating to the Service, whether in contract, tort, or otherwise, is limited to the fees you actually paid us in the twelve (12) months preceding the event giving rise to the claim. We are not liable for indirect, incidental, special, consequential, or exemplary damages, including loss of profits, loss of data, or business interruption, even if we have been advised of the possibility of such damages.
Nothing in these Terms limits liability that cannot be excluded under applicable mandatory law, including liability for death or personal injury caused by negligence, gross negligence, wilful misconduct, or your statutory consumer rights.
11. Suspension & termination
You can stop using the Service and delete your account at any time. We may suspend or terminate your access if you violate these Terms, fail to pay, create risk for us or other users, or if we decide to discontinue the Service. We will give reasonable notice where practical. On termination your subscription stops, and your workspace data is removed within 30 days (subject to backups and legal retention obligations).
12. Governing law
These Terms are governed by Austrian law, excluding conflict-of-law rules and the UN Convention on Contracts for the International Sale of Goods. The exclusive place of jurisdiction is the courts of Salzburg, Austria — except where mandatory consumer protection law of your country of residence requires otherwise.
EU online dispute resolution platform: ec.europa.eu/consumers/odr. We are not obliged and not willing to participate in dispute resolution proceedings before a consumer arbitration board.
13. Changes to these terms
We may update these Terms as the Service or law evolves. Material changes will be announced in-app or by email at least 14 days before they take effect. Continued use of the Service after the effective date constitutes acceptance of the updated Terms.
